Terms of Use

Gem Habits (“the app”) is made by Uppervox, the studio of Alexander Costa, a US-based individual (“we”). By downloading or using the app you agree to these terms.

1. Licence and Apple’s standard EULA

The app is licensed, not sold. Your use is governed by Apple’s Licensed Application End User License Agreement (the Standard EULA). These terms add to it. If they conflict, the Standard EULA controls on licence scope, warranty and liability. Apple is not responsible for the app, its support or any claim about it; Apple and its subsidiaries are third-party beneficiaries of the Standard EULA and may enforce it against you.

2. Wellness, not medical advice

Gem Habits is a habit and wellness tool. It is not a medical device and does not diagnose, treat, cure or prevent any condition. Streaks, goals and Apple Health figures (steps, sleep, exercise and so on) are for your personal motivation and may be incomplete or inaccurate. Do not rely on the app for medical decisions. Talk to a qualified professional before changing your exercise, sleep, diet or water intake, especially if you have a health condition. In an emergency call your local emergency number.

3. Free and Premium

The free tier allows up to 3 active rituals. Premium unlocks unlimited rituals; Apple Health, Apple Watch and wearable auto-complete; widgets on the Home Screen and the watch face; and your full history.

4. Subscriptions, free trials and cancellation

• Plans and prices. Premium is offered as auto-renewing subscriptions: $1.99 per week, $7.99 per month or $49.99 per year (US prices; other storefronts show local prices in the app before you buy).
• Free trials. The yearly plan includes a 7-day free trial and the weekly plan a 3-day free trial. Trials are for new subscribers who have not used a trial in this subscription group. If you do not cancel at least 24 hours before the trial ends, you are charged the plan price and the subscription renews.
• Payment. Charged to your Apple Account at confirmation of purchase, or at the end of the free trial.
• Auto-renewal. Your subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Manage or cancel. Settings → [your name] → Subscriptions on your iPhone, or apps.apple.com/account/subscriptions. Deleting the app does not cancel the subscription.
• Unused trial time is forfeited when you buy a subscription.
• Refunds are handled by Apple at reportaproblem.apple.com. We cannot issue refunds for App Store purchases.
• Restore. Use Restore purchases in Settings → Membership, or Restore on the paywall.
• Price changes. Apple will notify you and, where required, ask for your consent.

5. Your content

The rituals, notes and appointments you enter are yours. We do not receive or claim any rights in them. See the Privacy Policy.

6. Acceptable use

You agree not to reverse engineer, copy, resell or redistribute the app (except as the law allows), use it unlawfully, interfere with its operation, or misuse the support channel (harassment, spam). Do not enter content that is unlawful or infringes others’ rights; it stays on your device and in your iCloud, but you are responsible for it.

7. Availability and changes

We may update, change or discontinue features. If we discontinue the app, existing data stays on your device. We may update these terms; the date above shows the current version, and material changes will be flagged in release notes. Continuing to use the app after a change means you accept it.

8. Disclaimer

To the maximum extent permitted by law the app is provided “as is” and “as available” without warranties of any kind, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee uninterrupted, error-free operation, or that iCloud sync or Apple Health data will be complete or timely.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill. Our total liability to you for all claims is limited to the greater of the amount you paid for the app in the 12 months before the claim or US$50. Nothing here limits liability that cannot be limited by law, including consumer rights in your country.

10. Termination

Your licence ends automatically if you breach these terms. You may stop at any time by deleting the app and cancelling your subscription.

11. Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts and the United States, without regard to conflict-of-law rules, and disputes go to the courts of Massachusetts, except that mandatory consumer protections where you live (including EU and UK consumer law) still apply, and the Standard EULA governs between you and Apple.
